Louisville is mourning the loss of two lives following a devastating mass shooting. One person passed away at the scene of the accident while another was pronounced dead at the hospital. Four others are being treated for gun-related injuries.
The shooting took place at approximately 3 a.m. on Sunday Aug. 27, 2023 at the Southern Restaurant and Lounge. Located in the 300 block of Market Street, Louisville Metro Police Department (LMPD) claims that they had received multiple complaints about the lounge over the past month, including complaints regarding:
- Noise levels
- Patrons blocking sidewalks
- Parked vehicles on the sidewalks
- Blocked traffic
Following the series of complaints and the recent shooting, the operator’s lease is being terminated. The Alcoholic Beverage Control is also in the process of revoking their business license. However, these actions are too little, too late for the six victims.
What Business Owners Owe Their Patrons
Business and property owners are responsible for the safety and well-being of their patrons. And when a business owner has a known history of repeated safety violations and complaints, it is their duty to enact necessary and reasonable safety measures. This may include:
- Installing new or additional safety cameras
- Hiring security personnel
- Using metal detectors
- Enacting bag searches
- Installing more lighting
- Limiting the number of people allowed in at once
Dining out with family, meeting up with friends for a drink, or shopping with your kids should never put your life in harm’s way. When a business owner fails to uphold their duty of care to customers, they can be held liable for resulting damages like medical bills, lost wages, and more.
We know that we can never undo the harm that a victim or family has suffered following a crime, assault, or shooting. But what we can do is be part of the solution. Thomas Law Offices proudly represents injury victims and families who have lost loved ones to what should have been preventable acts.
