How Do I Know if My Hip Implant is Defective?

Published on Apr 20, 2017 at 11:00 am in Product Liability.

If you’ve had metal-on-metal hip replacement surgery, you’ve already been through a long surgery and recovery process that has almost assuredly affected your life and livelihood. As you’re recovering from surgery, you may have noticed certain side effects that are complicating the recovery process. Some side effects and complications are normal, but others are not.

You may also be aware that certain hip replacement implants are currently under FDA recall. Most hip implant surgeries have excellent outcomes, but others do not. Many of these poor outcomes are due to implants that are defective or do not hold up over time. When a hip replacement surgery patient is injured or suffers from a defective hip implant, that patient may face additional surgeries, a long and painful recovery process, or may not even recover at all.

Recalls are generally issued when situations like the above occur. Oftentimes device manufacturers design a model that isn’t properly tested or is rushed to market. Other times, a model is defective when it’s made with cheaper materials or parts. In both cases, the manufacturer can be held legally and financially liable for injuries that occur. By filing what is known as a product liability lawsuit or hip replacement lawsuit, a victim can get the financial help they need to recover.

If you’re wondering if your metal-on-metal hip implant is perhaps defective, watch for the following symptoms:

  • Numbness that lasts for an extended period
  • Severe hip or groin pain
  • Swelling
  • Other signs of infection including redness and any type of discharge
  • Changes in your ability to walk
  • Changes in the way the joint functions (including any strange noises it makes)
  • Symptoms of metallosis (metal poisoning)

Be sure to regularly check with your surgeon regarding any changes you notice during the recovery process. With a non-defective implant, your pain and stiffening should lessen significantly after the first few weeks and months after surgery. If any symptoms lessen and then begin to get worse again, this is  a sign that something may be wrong. Make sure to report all changes as soon as they occur.

Many defective hip implants do not begin to have issues until after the implant has been in use for two or more years. If your implant was working fine for a year or more and you begin to notice any of the above symptoms, you will want to seek medical help as soon as possible. This may a sign that something is wrong with the device.

One of the most popular manufacturers of defective hip implants is DePuy Orthopedics. Between the years 2006 and 2009, there were at least 300 reports of issues regarding DePuy hip devices. Some of these models were recalled, including these models listed below:

  • DePuy ASR™ XL Acetabular Hip System
  • DePuy ASR™ Hip Resurfacing System
  • DePuy Pinnacle Hip Replacement

Even if you are not sure that you had a DePuy ASR or Pinnacle hip implant inserted during surgery, you may still be eligible to file a lawsuit against the manufacturer of your device depending on the nature of the defect and how it occurred. To learn if you may be eligible to file a claim, you’ll need to get in touch with an experienced product liability attorney.
