Superior Care Home in Paducah To Pay $2.2M in Damages

Superior Care Home nursing home in Paducah, KY has been ordered by jurors to pay over $2 million in damages to the Moore family after the passing of 92-year-old Mary Opal Moore. The lawsuit against the facility alleged gross negligence and failure to provide proper care. Tad Thomas and Brain Jasper of Thomas Law Offices represented the family of the victim in the lawsuit.

Moore moved into Superior Care Home in December 2014. She resided there into 2015 for approximately three months. With a price tag of over $9,000 a month, the family chose the facility because of advertisements regarding a new memory care facility. They believed the medical professionals could help with Moore’s dementia.

While living there, Moore did not receive proper care and was kicked out without adequate justification in March. She died less than one month later. According to the lawsuit, the family claimed the nursing home’s negligence contributed to her accelerated physical and mental decline and her resulting death.

The negligent actions committed by the facility revolved around incomplete treatment. The complaint in the lawsuit stated that Moore did not receive the care she needed, including psychological consultations for her agitation. The complaint also accused the nursing home of kicking Moore out because of her upcoming change from a self-paying resident to a Medicaid patient.

After a three-hour deliberation following a week-long trial, jurors found Superior Care Home at fault. As a result, $580,000 was awarded in compensatory damages for medical expenses and pain and suffering. An additional $1,625,000 was awarded in punitive damages. Eddie Jones, the attorney who represented the nursing home, expects post-trial litigation, including the possibility of an appeal.

According to Tad Thomas, he and the family are “very grateful to the jury who gave us a fair trial and justice was served.” Unfortunately, justice isn’t always served for victims of abuse and neglect.
